1. Agreement to These Terms

These Terms of Service ("Terms") govern your use of AI Caricature, including our website, apps, APIs, and related services (collectively, the "Service").

By creating an account, purchasing credits or a plan, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility and Accounts

• You must be at least 13 years old (or older if required by your local law) to use the Service.
• You must provide accurate account information and keep it up to date.
• You are responsible for all activity under your account and for maintaining account security.
• You may not share your account or use another person's account without permission.

3. What the Service Does

AI Caricature provides AI-powered image generation and editing features. We may change, improve, or discontinue features at any time.

We may set usage limits, suspend abusive traffic, or block activity that threatens security, legal compliance, or platform stability.

4. Credits, Plans, Billing, and Refunds

4.1 Credits and Plans

• Certain actions (such as generation or regeneration) consume credits.
• Credit amounts, expiration rules, and plan benefits are shown in the app or checkout.
• Credits are limited digital service units. They are not cash, are not legal tender, and (unless required by law) are not redeemable for cash.

4.2 Subscriptions and One-Time Purchases

• Paid plans may renew automatically unless canceled before the next billing date.
• You authorize us and our payment provider to charge your selected payment method.
• Prices may change prospectively. Tax may be charged where required.

4.3 Refund Policy

• Except where required by applicable law, payments are non-refundable once digital services or credits are delivered.
• If you believe you were charged in error, contact us promptly and we will review in good faith.

5. Acceptable Use

You may not use the Service to:

• violate laws or third-party rights;
• upload content you do not have rights to use;
• create unlawful, abusive, harassing, defamatory, fraudulent, or harmful content;
• attempt to reverse engineer, scrape, overload, or interfere with our systems;
• bypass rate limits, security controls, or payment controls;
• distribute malware, spam, or other harmful code.

We may remove content or suspend accounts that violate these Terms.

6. Your Content and AI Output

6.1 Your Inputs

You retain ownership of the images, prompts, and other materials you submit ("Input"), subject to rights you grant in these Terms.

6.2 License to Operate the Service

You grant us a worldwide, non-exclusive, royalty-free license to host, process, reproduce, adapt, and transmit Input and Output as necessary to provide, secure, improve, and support the Service.

6.3 Output Rights

Subject to your compliance with these Terms and applicable law, you may use the generated output ("Output"). Because AI systems may produce similar results for different users, we do not guarantee uniqueness of Output.

6.4 Your Responsibility

You are responsible for ensuring you have all permissions needed for uploaded photos (including rights of depicted individuals where required by law).

7. Intellectual Property

The Service, including software, branding, design, and related content (excluding your Input and Output rights described above), is owned by AI Caricature or its licensors and protected by law.

8. Third-Party Services

We rely on third-party providers (for example, cloud infrastructure, payment processors, authentication providers, and AI model providers). Their services are subject to their own terms and policies.

9. Suspension and Termination

We may suspend or terminate access immediately if we reasonably believe you violated these Terms, created legal risk, or harmed the Service or other users.

You may stop using the Service at any time.

10. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

AI output may be inaccurate, incomplete, offensive, or unsuitable for your intended use. You are responsible for reviewing output before use.

11. Limitation of Liability

To the maximum extent permitted by law:

• we are not liable for indirect, incidental, special, consequential, or punitive damages; and
• our total liability for claims related to the Service will not exceed the greater of (a) amounts you paid us in the 12 months before the claim, or (b) USD $100.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless AI Caricature and its affiliates, officers, employees, and agents from claims, damages, liabilities, and expenses arising from your use of the Service, your content, or your violation of these Terms.

13. Governing Law

These Terms are governed by applicable laws of the jurisdiction in which the Service operator is established, without regard to conflict-of-law rules. Mandatory consumer protection rights in your place of residence remain unaffected.

14. Changes to These Terms

We may update these Terms from time to time. We will post the updated version on this page with a new "Last updated" date. Continued use of the Service after updates means you accept the revised Terms.
